This is a part time court. Phone calles may take up to 48-72 hours for return call.

Town Court Hours:

First four (4) Thursdays of the month - Starts at 6 PM.
1st Thursday - Vehicle Traffic/Town Prosecutor
2nd and 4th Thursdays - Criminal/Trials-ADA Night
3rd Thursday - Vehicle Traffic-Small Claims/Civil

FINE PAYMENTS:

Please be advised the Court Clerks cannot accept fine payments over the phone.

Fines and fees can be paid via cash, certified check, money order, or credit card (Master Card & VISA). There is a 2.99% fee if paying with credit. Money Orders or Certified Checks should be payable to the :

If you require a receipt, please include a self-addressed stamped envelope.

NOTE: The Town Court drop off box is located OUTSIDE the Town Hall entrance. All payments or correspondence must be placed in an envelope. THE TOWN CLERK'S OFFICE CANNOT ACCEPT PAYMENTS.

VEHICLE & TRAFFIC COURT PROCEDURE:

IT IS BENEFICIAL (BUT NOT REQUIRED) THAT YOU MAIL YOUR PLEA BACK TO THE COURT BEFORE YOUR COURT APPEARANCE DATE.

To Plead Guilty: fill in Section A and mail the ticket to the Court. After we receive your guilty plea you will receive a fine letter in approximately 2 to 4 weeks.
If you mail your plea in NOT GUILTY: you will be notified by mail of a new court date to appear and speak with the Town Prosecutor.
If you do not mail your plea in, you are expected to report on your scheduled court date and may plea in court.
It is the defendant's responsibility to ensure the court has the correct mailing address.

Regarding"Fix-It" Ticket Dismissals:

Please read your STATEMENT OF CORRECTION FOR EQUIPMENT DEFECT thoroughly.
Inspections are not dismissible in the state of NY.
Qualifying VTL violations (VTL 375, 376,and 381, except where both headlamps are defective and except a violation relating to service brakes or audio amplification systems) will be dismissed IF proof is presented to the court that the defect was corrected PRIOR TO 1/2 HOUR AFTER SUNSET ON THE FIRST BUSINESS DAY after issuance of the summons (VTL section 376-a).

CRIMINAL CALENDAR:

Criminal matters are schedued on the second and fourth Thursday of each month. Please contact the court or your attorney if you have questions about your appearance date.

EVICTIONS:

Evictions filed in the Town of Collins Court will be heard in Erie County's Landlord Tenant HUB Court. Filing must occur in the local court and not the HUB Court. Please contact the Court Clerk's Office at (716) 532-3340 ext 114 for a tentative court date for service purposes.

Small Claims/Civil Filings:

Small Claim proceedings may be brought by any individual against anyone who resides or owns a business in the Town of Collins. The maximum fee is $3,000.
The filing fee is $10, if the amount you are suing for is $1 up to $1,000 and $15, if the amount is $1,001 up to $3,000.
The filing fee is payable upon filing the application. The Court Clerk cannot accept an application without the filing fee.
